Pharmacy terms

These terms of service (referred to as the “Pharmacy Terms”) apply to the fulfilment of prescriptions for the goods by Feel Good Pharma Ltd (General Pharmaceutical Council registration number 9011329) of Unit 5, Oakwood Business Park, Park Royal, London, UK, NW10 6EX (referred to as the “Pharmacy”). Please read these Pharmacy Terms carefully.

We dispense goods on prescription (referred to as the “The Goods”) directly to you based on information provided to us by the clinic that has referred you to us. We do not dispense The Goods to anybody on your behalf. Your contractual relationship for The Goods is directly with us.

You confirm that you have authorised the clinic that has referred you to us to share your medical information and any prescriptions issued to you with us. You must notify us immediately if you withdraw that authorisation. You confirm that all of the information you have provided to the clinic that referred you to us in relation to your medical condition is complete and accurate.

You acknowledge that the clinic that referred you to us may notify us if you terminate your relationship with them, in which case these Pharmacy Terms may also terminate and we will cease to dispense The Goods.

Your prescription will only be dispatched to you by us if we approve the prescription for The Goods that have been recommended to you, and subject to us having received payment for The Goods from the clinic that referred you to us on your behalf.

We will only issue The Goods to you if a valid prescription has been issued by a licensed prescriber based upon a personal consultation and examination. The Goods are dispensed to you solely for your own personal use, to treat a specific condition that has been identified as applicable to you, and must not be shared with or used by any other person.

We will issue The Goods to you promptly following receipt of your prescription and you will receive an order confirmation email from us which will contain further details on The Goods. You should let us know if you do not receive The Goods within 30 working days of confirmation of your order. Title to The Goods passes to you when they leave our premises. We shall not be liable for any damages suffered due to delay in shipment or damage that may occur in transit.

We do not accept returns of any of The Goods unless they have been dispensed in error and are not in accordance with your prescription.

You must review any guidance and instructions that accompany any of The Goods before using them, including the Patient Information Document if applicable. You are responsible for use of The Goods in accordance with instructions.

You must notify your doctor and any other healthcare professional involved in treating you of your use of any of The Goods.

To the maximum extent permitted by law, we disclaim all warranties and representation, express or implied, in relation to The Goods supplied by us, including without limitation implied warranties and suitability for any particular purpose. Your sole remedy in relation to any claims relating to The Goods supplied by us is for us to provide a like-for-like replacement.

We shall not be liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including, without limitation, delays due to back orders or issues with postal and delivery services.

We may make changes to these Pharmacy Terms from time to time.

You may not assign any of your rights or obligations under these Pharmacy Terms to any third party. You understand that we may assign or license our rights and obligations under these Pharmacy Terms to any third party at our sole discretion.

No delay in enforcing any right arising under these Pharmacy Terms shall be construed as a waiver of such right.

These Pharmacy Terms and any disputes arising under them shall be governed by English law, and subject to the exclusive jurisdiction of the courts of England.
